  1. 1. PARTIES
    Identifies the Client (buyer or tenant) and the Broker who are entering into this representation agreement: "This agreement is made between ____ (Collectively, "Client") and ____ ("Broker")."
  2. 2. APPOINTMENT
    Formally appoints the Broker as the Client's real estate agent, establishing the agency relationship. No blanks.
  3. 3. DEFINITIONS
    Defines two key terms: 'acquire' (purchase or lease) and 'market area' (the geographic area in Texas where the broker will represent the client). The Market Area is the one blank — three ruled lines that must not be left blank.
  4. 4. TERM
    Sets the start and end dates for the representation agreement. The agreement automatically expires at 11:59 p.m. on the end date.
  5. 5. BROKER OBLIGATIONS
    Defines the broker's obligations and offers two service levels (check only one box): Full Services (best-efforts representation) or Showing Services (property access only for a flat fee due on execution). Under Showing Services, paragraphs 6, 7 and 8 do not apply.
  6. 6. CLIENT OBLIGATIONS
    Establishes the client's exclusive obligations: work only through this broker in the market area and inform all other parties that this broker is their exclusive representative. No blanks.
  7. 7. BROKER COMPENSATION
    Details the broker's compensation structure: 7A fee amounts for purchases and leases (complete all that apply), 7B when fees are earned (contract execution) vs. payable (closing or client breach), 7C the source of payment (seller/landlord contributions credited toward client obligation), and 7D escrow authorization for fee collection.
  8. 8. INTERMEDIARY
    Addresses whether the client authorizes the broker to act as an intermediary when the client wants to acquire one of the broker's own listings ("Client ☐ does or ☐ does not authorize Broker…"). Includes the required statutory disclosures about intermediary duties and restrictions on confidential information.
  9. 9. LIMITATION OF LIABILITY and Legal Notices
    Limits broker liability and contains the closing notices: the agreement is legally binding, attorney consultation is recommended, and the parties authorize electronic signatures. No blanks.
  10. Signatures
    Signature block for the broker (or broker's associate), with license numbers, and up to two clients. Signature lines and the "Date" beside them are e-sign tabs placed when the document is sent.
