The TXR 2509 form is organized into the following sections:

  1. 1. Introduction
    Provides historical context explaining that mineral rights have become increasingly important in urban/suburban areas due to large mineral discoveries and advances in drilling technology (such as horizontal drilling and hydraulic fracturing).
  2. 2. Who Owns the Minerals?
    Explains that most property owners do not know the extent of their mineral interests, that mineral rights may be partially or fully severed or leased, and that an oil and gas attorney is needed to determine mineral ownership through a chain of title review.
  3. 3. Contract Forms
    Explains that standard TREC and TXR contracts default to conveying all mineral interests to the buyer. The seller must attach TREC 44-2 / TXR 1905 to reserve any mineral interests in residential deals. Farm and ranch transactions allow attorney-drafted addenda as well.
  4. 4. Resources
    Directs parties to the Real Estate Research Center at Texas A&M and the Railroad Commission of Texas for additional information about mineral estates and mineral leases.
  5. Acknowledgment of Receipt
    "The undersigned acknowledge receipt of this notice." Two "Printed Name:" lines, each with a signature line and "Date" under it, for one or two recipients. The signature and date lines are placed as e-sign tabs when the form is sent.
