Form Outline

The TXR 2501 form is organized into the following sections:

  1. Types of Real Estate License Holders
    Explains the distinction between brokers and sales agents in Texas. Brokers are responsible for all brokerage activities, including those of their sponsored agents. Sales agents must operate under a sponsoring broker.
  2. Broker's Minimum Duties Required by Law
    Outlines the four minimum fiduciary duties a broker owes to their client: prioritizing client interests, disclosing material information, answering questions and presenting offers, and treating all parties honestly and fairly.
  3. Written Agreements Required in Certain Situations
    States that written buyer representation agreements are mandatory before showing residential property or presenting offers. References Texas Occupations Code Section 1101.563. Recommends all broker-client agreements be in writing, clearly establishing duties and compensation.
  4. As Agent for Owner (Seller/Landlord)
    Explains seller/landlord agency. The broker becomes the owner's agent through a written agreement (listing or management). The owner's agent must perform minimum duties, disclose all material information including info from buyers/buyer's agents, and their fees are fully negotiable.
  5. As Agent for Buyer/Tenant
    Explains buyer/tenant agency. The broker becomes the buyer's agent through a written representation agreement. The buyer's agent must perform minimum duties, disclose all material information including info from sellers/seller's agents, and their fees are fully negotiable.
  6. As Agent for Both — Intermediary
    Describes intermediary status where one broker represents both sides. Requires written consent from each party. The intermediary must be impartial, may appoint different associates to each party, and must protect confidential information including price negotiation positions.
  7. Showing Property Without Representing Buyer/Tenant
    Explains the limited circumstances under which a license holder may show property without representing the buyer/tenant. Even for unrepresented buyers of residential property, a written agreement (non-exclusive, max 14 days) is now required per Section 1101.563.
  8. License Holder Contact Information
    Contact information section where the license holder fills in their brokerage details across four rows: sponsoring broker, designated broker, licensed supervisor, and sales agent/associate. The client initials and dates to acknowledge receipt.
