TXR 2232Notice to Pay Rent or Vacate

One-page notice under Texas Property Code Section 24.005(f-3) for a tenant whose only breach is nonpayment of rent in the current month, with no earlier late or delinquent rent. It states the date rent went unpaid, the total amount past due, the daily late charge, and the deadline to pay; warns that if the tenant does not cure, the landlord may terminate the right to occupy effective a stated number of days after the notice is delivered to the Property; reserves all remedies; is signed by the landlord or the landlord's property manager; and records the means of delivery (certified mail, affixed to the inside of the main entry door, hand delivered, regular mail, or electronically if previously agreed).

The TXR 2232 form is organized into the following sections:

  1. Header / Identification
    "To: ___ (Tenant(s))", "From: ___ (Landlord)" and "Re: Lease concerning the Property at ___" (the address continues on a full-width second line).
  2. A. Notice
    "Tenant(s) are in breach of the above-referenced Lease solely due to the nonpayment of rent on ___ but has not been late or delinquent in paying rent before the month in which this notice is being provided." — the first-time-nonpayment language Texas Property Code 24.005(f-3) requires.
  3. B. Opportunity to Cure
    "You may avoid further action by paying $___, which is the total amount past due as of the date of this notice, inclusive of unpaid rent and other charges. For each day after the date of this notice you must pay an additional late charge of $___ per day. You must remit payment not later than ___ to the place your Lease requires."
  4. C. Failure to Cure
    "Should Tenant(s) fail to comply with the opportunity to cure as stated in Paragraph B, Landlord may exercise the right to terminate Tenant's right to occupy the Property effective ___ days after the date this notice is delivered to the Property pursuant to Texas Property Code 24.005 (f-3)."
  5. D. Remedies
    Printed text: "Landlord is entitled to pursue all available remedies for Tenant's breach." No blanks.
  6. Signature
    The "Landlord … Date" rule, then "Or signed for Landlord under written Property Management Agreement or power of attorney: By: ___" (no Date beside it on this form) with "Printed Name:" and "Firm Name:" beneath. Signature lines and the Landlord's Date are e-sign tabs.
  7. Means of Delivery
    The boxed panel: "❑ Certified Mail, Return Receipt Requested No. ___ / ❑ Affixed to inside of main entry door on ___ by ___ / ❑ Hand delivered to ___ on ___ by ___ / ❑ Regular Mail / ❑ Electronically (if previously agreed to) via ___". Because this notice also serves as a notice to vacate under 24.005(f-3), delivery per the statute matters.
