TXR 2230Notice of Late Rent Breach of Lease

Two-page landlord notice that the tenant is in breach of a residential lease for late or unpaid rent, with an opportunity to cure. A. Late Notice covers (1) the breach — rent not paid for stated periods, rent paid late, or a payment returned unpaid — and (2) the cure: the total past due, the daily late charge, the payment deadline, and the means by which the cure payment and future payments must be made (check, cashier's check, money order, other). B. states that a payment was applied to non-rent obligations under Paragraph 4G of the Lease (Paragraph 8 for Leases dated on or before January 4, 2026), leaving an unpaid rent balance due by a date. C. addresses rent wrongfully withheld. Page 2 warns of the landlord's remedies, the Penal Code bad-check offense and the suspension of repair duties while rent is delinquent, carries the landlord / property manager signature block, and records the means of delivery.

The TXR 2230 form is organized into the following sections:

  1. Header / Identification
    "To: ___ (Tenant(s))" and "Re: Lease concerning the Property at ___" (the address continues on a full-width second line and repeats in the page-2 running header).
  2. A. Late Notice
    (1) Late Rent: "You are in breach of the above-referenced lease because:" ❑ (a) rent not paid for the stated period(s), ❑ (b) rent for a month paid late and received on a date, ❑ (c) a payment returned unpaid. (2) Opportunity to Cure: (a) the total past due, the daily late charge, the deadline, and the means the cure payment may be made by; (b) the means future payments may be made by.
  3. B. Application of Rent Payment to Non-Rent Obligations
    "In accordance with Paragraph 4G of the Lease (Paragraph 8 for all Leases dated on or before January 4, 2026) Landlord has applied your payment dated ___ to the following unpaid items: ___. Therefore, there is an unpaid balance of your rent in the amount of $___. Please pay this amount not later than ___."
  4. C. Wrongful Withholding of Rent Payment
    "You wrongfully withheld a portion of your rent payment that was due ___. You are not permitted under the lease to withhold rent. You may cure this breach of the lease by paying $___, which is the total amount past due as of the date of this notice, inclusive of unpaid rent and other charges. For each day after the date of this notice you must pay an additional late charge of $___ per day."
  5. Failure to Comply / Notice
    Page 2 printed text: the Landlord may pursue all available remedies if the tenant fails to comply (termination of the right to occupy by separate notice, damages, attorney's fees, court costs); under Penal Code Section 32.41 a bad check is a criminal offense; under Property Code Section 92.052 the Landlord need not make repairs while rent is delinquent. No blanks.
  6. Signature
    Page 2: the "Landlord … Date" rule, then "Or signed for Landlord under written property management agreement or power of attorney: By: ___ … Date" with "Printed Name:" and "Firm Name:" beneath. Signature lines and their dates are e-sign tabs.
  7. Means of Delivery
    The boxed panel at the foot of page 2: "❑ Regular US Mail ❑ Certified Mail, Return Receipt Requested No. ___ / ❑ E-Mail ___ / ❑ Hand delivered to ___ on ___ by ___ / ❑ Other: ___".
