TXR 2224Notice of Abandonment

This form provides formal notice from a landlord to a tenant that the landlord considers the property abandoned. Under Texas Property Code, when a tenant has failed to pay rent and, in the landlord's reasonable judgment, the tenant and all occupants have vacated the property, the landlord may deliver this notice by affixing it to the inside of the main entry door (or the outside, if entry is prevented). The tenant must notify the landlord that the property is not abandoned within 2 days of affixing or by a stated date; otherwise the landlord may dispose of, donate, or store and sell personal property left behind under §54.045(b)-(e), Property Code, and the tenant must reimburse the landlord's reasonable costs (Paragraph 13C(2) of the lease; 16C(2) for leases dated on or before January 4, 2026). Signed by the landlord or by the broker under a written property management agreement or power of attorney, with a Means of Delivery record.

Form Outline

The TXR 2224 form is organized into the following sections:

  1. Notice Header and Property Identification
    "To: ___ (Tenant) / From: ___ (Landlord) / Re: Lease concerning the Property at ___" (the property blank continues on a second line).
  2. A. Declaration of Abandonment
    Printed text: "Because (i) Tenant has failed to timely pay rent as required by the above-referenced Lease; and (ii) in Landlord's reasonable judgment, Tenant and all occupants have vacated the Property, Landlord considers the Property abandoned."
  3. B. Tenant Response Requirement
    "Tenant must notify Landlord that Tenant has not abandoned the Property (check only one box): ❑ (1) Within 2 days after the date this notice is affixed to the Property. ❑ (2) By ___. Note: Do not insert a date earlier than 2 days from the date the notice is: (i) affixed to the inside of the main entry door; or (ii) affixed to the outside of the main entry door, if Landlord is prevented from entering the Property."
  4. C. Landlord's Remedies Upon Abandonment
    Printed text: failure to respond by the time required authorizes the landlord to (1) dispose of personal property in the trash or a landfill; (2) give it to a charitable organization; or (3) store and sell it under §54.045(b)-(e), Property Code; the tenant must reimburse the landlord's reasonable packing, removal, storage and sale costs (Paragraph 13C(2) of the Lease; 16C(2) for Leases dated on or before January 4, 2026).
  5. Landlord Signature
    "Landlord ___" (no Date); "Or signed for Landlord under written property management agreement or power of attorney: By: ___" (no Date); "Printed Name: ___"; "Firm Name: ___". Signature lines are e-sign tabs placed when the document is sent.
  6. Means of Delivery
    "❑ Affixed to inside of main entry door on ___ by ___. / ❑ Affixed to outside of main entry door on ___ by ___ because entry was prevented." Each row has its own date and person; only the selected row's pair is asked for.
