Form Outline

The TXR 2223 form is organized into the following sections:

  1. Underlying Agreement and Property Identification
    Identifies which listing or property management agreement this authorization relates to by selecting one of four checkbox options, and specifies the property address.
  2. Authorization for Access Method
    Authorizes the broker to use a specified access control and identity verification method for showing the vacant property to prospective tenants. Requires the property to be vacant with no personal property remaining except items conveying to the tenant. Includes an MLS compliance notice regarding keybox code sharing.
  3. Owner's Consent to Unescorted Access
    The owner explicitly acknowledges and consents to the fact that prospective tenants may view the property without an agent or broker present as a result of the access method employed.
  4. Liability and Indemnification
    Assigns liability for damage, injury, or loss from unescorted access to the owner (except for broker negligence). The owner indemnifies the broker and broker's agents, covering costs, attorney's fees, and expenses.
  5. Execution by Broker and Owner
    Provides signature blocks for the broker (with printed name, license number, and date), the broker's associate if signing as an authorized agent, and up to two property owners (with printed names, signatures, and dates). Includes a disclaimer about legal advice.
