TXR 2221Amendment to Residential Leasing and Property Management Agreement

TXR 2221 provides a standardized way to amend an existing Residential Leasing and Property Management Agreement (TXR 2201) between a property owner and a broker. It allows the parties to update specific paragraphs of the original agreement — Paragraph 1 (the parties: owner and broker contact information, the owner's entity type and signing capacity), Paragraph 3A (the primary term's commencement and expiration dates), and any other paragraph(s) written out in full — and lets the owner notify the broker of changes affecting ownership of the property. Initialed on page 1 and signed by the Broker (or the Broker's Associate) and the Owner(s).

Form Outline

The TXR 2221 form is organized into the following sections:

  1. Agreement Identification
    "CONCERNING THE RESIDENTIAL LEASING AND PROPERTY MANAGEMENT AGREEMENT BETWEEN ___ (Broker) AND ___ (Owner) FOR THE FOLLOWING PROPERTY: ___" — the property is repeated in the running header of page 2.
  2. A. Paragraph 1 (Parties) is changed to read as follows
    "❑ A. Paragraph 1 of the agreement is changed to read as follows." — the full ¶1 PARTIES block: A. the Owner's and Broker's contact information; B. "If Owner is not an individual, Owner is a: ❑ estate ❑ corporation ❑ limited liability company (LLC) ❑ trust ❑ partnership ❑ limited liability partnership (LLP), which entity was charted or created in ___ (State). The individual signing this agreement for the owner … is acting under his capacity as ___ (title) for the Owner."; C. the exclusive agency appointment (no blank).
  3. B. Paragraph 3A (Primary Term) is changed to read as follows
    "❑ B. Paragraph 3A of the agreement is changed to read as follows. A. Primary Term: The primary term of this agreement begins and ends as follows: Commencement Date: ___ Expiration Date: ___"
  4. C. Other paragraphs are changed as follows
    "❑ C. Paragraph(s) ___ are changed as follows:" followed by open space on page 2 (no printed rules, about sixteen lines).
  5. D. Changes affecting Owner's ownership of the Property
    "❑ D. Owner notifies Broker of the following changes affecting Owner's ownership of the Property. ___" — a short stub after the sentence plus three full lines.
  6. Execution and Signatures
    "Broker's Printed Name … License No." with "By: ___ Broker's Associate's Signature … Date" beneath it; two "Owner" printed-name lines each with a "By ___ Date" signature line beneath. Signature lines and their Dates are e-sign tabs placed when the document is sent. Page 1 also carries "Initialed for Identification by: Broker/Associate ___ and Owner ___, ___" (initial tabs).
