TXR 2213Agreement to Pay Past Due Amounts Under Lease

A binding agreement between landlord and tenant for repayment of past-due amounts under an existing residential lease in up to four dated installments. The tenant may remain in the property while strictly complying with the agreement and the lease; if an eviction has been or will be filed, the parties agree to entry of an eviction judgment that the landlord will not enforce, and will release or dismiss, as long as the tenant pays on time. Time is of the essence; a default puts the tenant in breach of the lease with no further notice to vacate required.

  1. Property Identification
    "CONCERNING THE RESIDENTIAL LEASE OF THE PROPERTY AT ___" (two lines).
  2. A. Past Due Amounts
    "A. Tenant has failed to timely pay the following itemized amounts under the above-referenced Lease: ___. The total amount that is past due, as of ___, is $___ (Past Due Amount)."
  3. B. Payment Schedule
    "B. Tenant agrees to pay, at the place where rents are due under the Lease, the Past Due Amount as follows: $___ on or before ___; $___ on or before ___; $___ on or before ___; and $___ on or before ___."
  4. C. Other Lease Obligations
    "C. In addition to the payments under Paragraph B, Tenant shall timely pay all other amounts under the Lease and comply with all other provisions of the Lease." (print only)
  5. D. Continued Occupancy and Eviction
    "D. Tenant may continue to reside in the Property provided Tenant strictly complies with this agreement and the Lease. If Landlord has commenced an eviction proceeding or will file an eviction proceeding, Landlord and Tenant will agree to the entry of eviction judgment against Tenant and, as long as Tenant is not in breach…, Landlord: (1) will NOT request a writ of possession; and (2) will move to release or dismiss any eviction judgment against Tenant at the time Tenant has timely paid the Past Due Amount in full."   6. E. Landlord's Rights Preserved
    "E. Landlord's acceptance of this agreement does not amend the Lease or waive any of Landlord's rights… If Tenant fails to strictly comply…: (1) Landlord shall not be required to provide Tenant a subsequent notice to vacate if Landlord has previously provided such a notice to Tenant; and (2) Landlord shall be entitled to exercise all remedies under the Lease."   7. F. Time Is of the Essence
    "F. Time is of the essence for the payment of the amounts under Paragraph B and C; strict compliance with the time by which the amounts are due is required." (print only)

    One "Landlord … Date" line; "Or signed for Landlord under written property management agreement or power of attorney: By: ___ Date" with "Printed Name:" and "Firm Name:"; four "Tenant … Date" lines.
