TXR 2208Notice to Vacate

The landlord's formal written notice to the tenant that the tenant's right to occupy the property is terminated for a lease violation (nonpayment of rent or another stated breach), effective a stated number of days after delivery or on a stated date. It satisfies the notice-to-vacate requirement of §24.005, Texas Property Code, the prerequisite to filing a forcible entry and detainer (eviction) suit, and records how the notice was delivered.

Form Outline

The TXR 2208 form is organized into the following sections:

  1. Header / Identification
    "To: ___ (Tenant(s))", "From: ___ (Landlord)", "Re: Lease concerning the Property at ___" (two lines).
  2. A. Reason for Breach
    "A. Tenant failed to comply with the above-referenced lease due to the following reason(s): ❑ (1) Nonpayment of rent. ❑ (2) Other: ___." Check every reason that applies.
  3. B. Termination of the Right to Occupy
    "B. Landlord terminates Tenant's right to occupy the Property: ❑ (1) effective ___ days after the date this notice is delivered to the Property pursuant to §24.005, Texas Property Code ❑ (2) effective ___." Check one.
  4. C. Demand to Vacate
    "C. Landlord demands that Tenant vacate the Property not later than the date stated in Paragraph B." (print only)
  5. D. Remedies
    "D. Landlord is entitled to pursue all available remedies for Tenant's breach." (print only)
  6. Signature
    One "Landlord … Date" line, then "Or signed for Landlord under written Property Management Agreement or power of attorney: By: ___" (no Date beside it) with "Printed Name:" and "Firm Name:" beneath.
  7. Means of Delivery
    "❑ Certified Mail, Return Receipt Requested No. ___. ❑ Affixed to inside of main entry door on ___ by ___. ❑ Hand delivered to ___ on ___ by ___. ❑ Regular Mail ❑ Electronically (if previously agreed to) via ___". Check every method used.
