TXR 2206 — Owner's Notice Concerning Condition of Property Under Property Management Agreement

This form is a comprehensive property condition disclosure completed by the owner for the property management broker. It documents the property's systems, equipment, appliances (a Y / N / U inventory with additional information), known repair needs, owners' association information, deed-restriction violations, lawsuits and health or safety conditions, the water source, roof, parking, mailbox, access codes, utility shut-off locations, written warranties and the current service providers — the details the broker needs to manage and lease the property. The notice is not a warranty of any kind. Signed by the Owner(s).

Form Outline

The TXR 2206 form is organized into the following sections:

  1. Property Identification and Disclaimer
    "CONCERNING THE PROPERTY AT ___" (repeated in the running header of page 2). "OWNER IS TO COMPLETE THIS FORM TO THE BEST OF THE OWNER'S KNOWLEDGE. THIS NOTICE IS NOT A WARRANTY OF ANY KIND."
  2. Section 1. The Property has the items marked below
    "(Mark Yes (Y), No (N), or Unknown (U).)" — a table of 27 items with Y / N / U cells and an Additional Information cell. The Owner marks each item; the printed prompts in the Additional Information cell (type, number of units, describe, location…) have their own blanks.
  3. Section 2. Items in need of repair
    "Are you aware of any item, equipment, or system in or on the Property that is in need of repair? ❑ yes ❑ no If yes, explain (attach additional sheets if necessary): ___" (a stub after the question and four full lines). Note: unless instructed otherwise, items will be repaired in accordance with the repair provisions in the lease the Broker negotiates for the Owner.
  4. Section 3. Are you aware of any of the following?
    Four Y / N questions: owners' associations or maintenance fees or assessments (with the association's name, manager, phone, address, common areas, user fees and any other association); notices of violations of deed restrictions or governmental ordinances; lawsuits or other legal proceedings; any condition materially affecting health or safety. "If the answer to any of the items in Section 3 is yes, explain (attach additional sheets if necessary): ___".
  5. Section 4. Other Information
    (1) water supply; (2) roof type and approximate age; (3) parking spaces if a condominium or townhome; (4) mailbox location and number; (5) alarm, garage door, access, gate and common facility codes; (6) locations of the heating & cooling filters (and filter sizes), electrical breakers, water and gas shut-off valves; (7) written warranties; (8) the current service providers and their phone numbers.
  6. Owner Signatures
    Two "Signature of Owner … Date" lines at the foot of page 2 — e-sign tabs placed when the document is sent.
