Form Outline

The TXR 2013 form is organized into the following sections:

  1. Header
    Identifies the property address and links the addendum to the residential lease.
  2. Representations
    Establishes baseline representations from both parties. The landlord confirms no knowledge of bed bugs. The tenant confirms inspection and no evidence found. The tenant must also disclose whether they have any prior bed bug history -- if yes, they must confirm professional treatment was completed.
  3. Notice
    Requires the tenant to immediately provide written notice to the landlord upon discovering bed bugs or experiencing bed bug-related bites or irritations. The notice obligation extends to discoveries in personal property and symptoms experienced by any occupant, family member, or guest.
  4. Treatment
    Defines treatment procedures once bed bugs are confirmed. The tenant must grant property access without prior notice for inspections/treatments, follow all cleaning instructions, dispose of untreatable items, and pay all reasonable costs if the infestation was caused by the tenant or associated persons. The landlord has sole discretion over pest control selection and treatment method.
  5. Liability
    Unless the landlord caused the infestation, the landlord is not liable for any bed bug-related damages to persons or property. The tenant must indemnify and hold harmless the landlord and landlord's agents from all bed bug-related claims, costs, and expenses if the infestation was caused by the tenant or associated persons.
  6. Default
    Non-compliance with the addendum triggers lease default remedies under Paragraph 27 of the lease, PLUS an immediate obligation to reimburse the landlord for all amounts owed under this addendum.
  7. Resources for More Information
    Provides three official resource websites where tenants can learn more about bed bugs: Texas DSHS, U.S. EPA, and Texas A&M Agrilife Extension.
  8. Signatures
    Signature blocks for up to two landlords, up to four tenants, and optionally a property management representative, each with corresponding dates.
