Form Outline

The TXR 2008 form is organized into the following sections:

  1. Property
    "ADDENDUM TO RESIDENTIAL LEASE CONCERNING THE PROPERTY AT" — the two-line address blank under the title. For use in the lease of residential property built before 1978.
  2. A. LEAD WARNING STATEMENT
    Contains the federally mandated lead warning statement explaining that pre-1978 housing may contain lead-based paint, that it poses health hazards particularly for children and pregnant women, and that landlords must disclose known hazards and provide the EPA pamphlet. No blanks.
  3. B. DISCLOSURE
    Two-part disclosure. (1) Presence of lead-based paint and/or lead-based paint hazards — check (a) Landlord knows of the following hazards (describe) or (b) Landlord has no knowledge. (2) Records and reports available to Landlord — check (a) Landlord has provided Tenant with all available records and reports (listed here) or (b) Landlord has no reports or records.
  4. C. TENANT'S ACKNOWLEDGEMENT
    The tenant acknowledges receiving all disclosed information from Paragraph B and the EPA pamphlet on lead poisoning prevention — one box for each.
  5. D. AGENTS' NOTICE TO LANDLORD AND ACKNOWLEDGEMENT
    Documents that the agents have notified the landlord of all lead-based paint disclosure obligations under federal law and that the agents are aware of their own responsibility to ensure compliance. Lists all five specific obligations the landlord must fulfill. No blanks.
  6. E. CERTIFICATION OF ACCURACY
    All parties certify that the information provided in the addendum is true and correct to the best of their knowledge. No blanks.
  7. Signatures
    Signature lines for up to two Landlords, up to four Tenants, the Listing Broker/Agent or Property Manager, and the Other Broker/Agent, each with a Date.
