TXR 2007 — Residential Lease Guaranty

Two-page form: page 1 is the guaranty in which one or two guarantors personally guarantee the tenants' performance of all obligations under the described lease (scope of payments and breaches, duration through renewals up to a cut-off date, joint and several liability, attorney's fees, whether a credit application is submitted, special provisions); page 2 is the Application for Guarantor of Residential Lease collecting each guarantor's personal, identification and employment information, the non-refundable application fees, and the authorization to obtain consumer / credit reports. Guarantors sign both pages.

Form Outline

The TXR 2007 form is organized into the following sections:

  1. A. Guaranty of Performance
    In consideration for Landlord leasing the Property to Tenant, the undersigned Guarantors guarantee the performance of all Tenants under the lease described here: landlord(s), tenant(s), property, commencement and expiration dates, and monthly rent — exactly as on the lease.
  2. B. Scope of Guaranty
    Printed only — no blanks. If any Tenant fails to make any payment under the lease (rent, late charges, returned check charges, attorney's fees, repair costs, animal charges, utility charges, reimbursements, maintenance charges, property damage and other charges), Guarantors will, upon demand, pay Landlord; if Tenant otherwise breaches, Guarantors will cure the breach or compensate Landlord for the loss.
  3. C. Duration and Renewal
    The guaranty applies when the lease commences and continues until the lease ends, including any extension or renewal. The last date on which a renewal of the lease will renew the obligation of Guarantors is the blank here; Guarantors waive notice of acceptance, modification, amendment, extension, renewal or breach other than as it pertains to this paragraph.
  4. D. Joint and Several Liability
    Printed only — no blanks. Guarantors are jointly and severally liable for all provisions of this guaranty.
  5. E. Attorney's Fees
    Printed only — no blanks. A prevailing party in any legal proceeding brought under or related to this guaranty is entitled to recover attorney's fees from the non-prevailing party.
  6. F. Credit Application
    "Guarantors ☐ will ☐ will not submit (as Page 2 of this document) an application which authorizes Landlord or Landlord's agent to verify information related to Guarantors' creditworthiness."
  7. G. Special Provisions
    Any additional terms, conditions or modifications agreed upon by the parties. The form leaves unruled white space under the heading; the text is drawn there. Guarantors may request a copy of the lease from the Tenant or the broker to the lease.
  8. Application for Guarantor of Residential Lease (page 2)
    The page 2 credit application: the lease description repeated, then for each of up to two guarantors — name (as listed on proof of identification), address, e-mail, phone and alternate phone, Social Security number, driver license / ID number and state, date of birth, relationship to Tenant, marital status, citizenship, employer and employer's address, supervisor's name, phone and fax, start date, gross monthly income and position — and the non-refundable application fee(s). Guarantors authorize Landlord to obtain their consumer / credit reports and verify the information.
  9. Signatures
    Guarantor signature lines with "Date" on both pages — the guaranty (page 1, with a Printed Name line under each) and the application (page 2). Signed electronically.
