Form Outline

The TXR 2004 form is organized into the following sections:

  1. Property
    "ADDENDUM TO RESIDENTIAL LEASE CONCERNING THE PROPERTY AT" — the two-line address blank under the title.
  2. A. ANIMAL AUTHORIZATION AND DESCRIPTION
    Three-part section: (1) explains assistance animal reporting requirements and that reasonable accommodation requests are needed, with no fees charged if accepted; (2) prohibits any unauthorized animals even temporarily; (3) four rows describing each authorized animal — Type, Breed, Name, Color, Weight, Age, Gender, and the Spayed/Neutered, Rabies Shots Current and Assistance Animal yes/no boxes.
  3. B. CONSIDERATION
    Establishes the financial terms for keeping animals. Does not apply to assistance animals. "Check any one or any combination": (1) a refundable animal deposit added to the security deposit, (2) a monthly animal fee due with rent, (3) a one-time non-refundable animal fee.
  4. C. ANIMAL RULES
    Establishes seven mandatory care and conduct rules for all animals on the property, covering behavioral responsibility, legal compliance, vaccination, confinement, waste removal, and offspring removal. No blanks.
  5. D. ACCESS
    Requires the tenant to remove or confine animals whenever they could interfere with the landlord's or authorized persons' access to the property for maintenance, inspections, showings, or other permitted purposes. No blanks.
  6. E. DISCLOSURE CONCERNING ANIMALS
    Requires the tenant to disclose any known bite or injury history and any known aggressive propensities of the animals being authorized. If either answer is yes, a written explanation is required.
  7. F. TENANT'S LIABILITY
    Establishes comprehensive tenant liability for all animal-related damage, injuries, and property damage. Tenant is responsible for all costs to clean, deodorize, deflea, or repair any part of the property including flooring, doors, walls, window coverings, furniture, appliances, sod, yard, fences, and landscaping.   8. G. INDEMNIFICATION
    Broad indemnification clause requiring the tenant to protect, defend, and hold harmless the landlord, property manager, and their agents from all damages, costs, attorney's fees, and expenses arising from any animal-related incident or tenant act. No blanks.
  9. H. DEFAULT
    Provides that breach of any provision in the Animal Agreement allows the landlord to immediately terminate animal authorization (in addition to all lease default remedies), requiring the tenant to immediately remove the animal from the property. No blanks.
  10. I. SPECIAL PROVISIONS
    Open space (no ruled lines) under the heading for any special provisions related to the animal agreement that are not covered by the standard sections.
  11. Signatures
    Signature lines for up to two Landlords and up to four Tenants (each with a Date), plus "Or signed for Landlord under written property management agreement or power of attorney: By / Printed Name / Firm Name".
