Form Outline

The TXR 2001 form is organized into the following sections:

  1. Parties
    Establishes the parties to the lease: landlord, tenant(s), and any additional occupants with their names and dates of birth.
  2. Property
    Describes the leased property including address, legal description, county, and any personal property items included with the lease.
  3. Lease Term and Rent Fees
    Defines the lease duration, monthly rent, first month's rent payment, prorated rent, security deposit, and additional monthly fees.
  4. Rent Details
    Details rent payment timing, location, accepted methods, rent increase rules, late fee structure, returned payment fees, fund application order, and occupancy delay provisions.
  5. Automatic Renewal and Notice of Termination
    The lease auto-renews month-to-month unless written termination notice is given. Specifies notice requirements for both primary term expiration and month-to-month termination.
  6. Animals
    Prohibits all animals unless agreed in writing. Assistance animals are exempt but must be documented. Violations carry financial penalties and landlord remedies including animal removal.
  7. Security Deposit Details
    Governs the security deposit including statutory definition, prohibition on withholding last month's rent, 30-day accounting requirement, no interest provision, extensive allowable deductions, and tenant liability for excess charges.
  8. Utilities
    Tenant is responsible for all utilities unless landlord agrees to pay specific ones. Minimum required utilities must be maintained throughout the lease.
  9. Use and Occupancy
    Establishes property use restrictions including HOA compliance, prohibited activities (pools, businesses, cannabis, short-term rentals), guest stay limits, and common area fee responsibility.
  10. Parking Rules
    Sets vehicle limits, prohibits yard parking, allows towing of violating vehicles at tenant's expense, and requires tenant to report vehicle information changes.
  11. Access by Landlord
    Establishes landlord's rights to advertise, enter the property for repairs/showings, charge trip fees for denied access, and place a keybox on the property.
  12. Move-In Condition
    Establishes as-is acceptance with sight-unseen notice, landlord's limited condition representations, and tenant's obligation to complete an Inventory and Condition Form within a deadline.
  13. Move-Out
    Establishes move-out condition requirements, defines surrender vs. abandonment, and covers landlord's rights to dispose of personal property left after move-out.
  14. Property Maintenance
    Details tenant's 14 maintenance responsibilities, yard maintenance options, property alteration prohibitions, smoking policy, and landlord's remedies for maintenance failures.
  15. Repairs
    Governs repair request procedures, landlord and tenant repair cost responsibilities, the 7-day repair period, tenant remedies under Texas Property Code, and advance payment requirements.
  16. Security Devices and Exterior Door Locks
    Mandates specific security devices per Texas Property Code Chapter 92, requires rekeying between tenants within 7 days, and establishes procedures for security device modifications.
  17. Smoke Alarms
    Requires smoke alarms per Texas Property Code and imposes penalties for tampering with or disabling smoke alarms.
  18. Liability
    Limits landlord's liability for most casualty and environmental losses and requires tenant to reimburse landlord for tenant-caused damages.
  19. Holdover
    Holdover rent is 3x monthly rent calculated daily, payable immediately without demand, plus tenant must indemnify landlord for all damages including eviction costs.
  20. Landlord's Lien, Subordination, Casualty Loss, Special Provisions
    Covers landlord's lien rights on tenant property, lease subordination to mortgages and HOA, casualty loss allocation, and special provisions with a warning against lease-purchase clauses.
  21. Default
    Establishes default remedies: tenant may seek legal relief for landlord default; landlord gets termination with 1-day notice, rent acceleration, lien enforcement, 18% interest, and full cost recovery for tenant default.
  22. Early Termination
    Restricts early termination except by agreement, default, or statutory rights (military, family violence, sex offenses/stalking). Provides replacement tenant process with fee options.
  23. Attorney's Fees, Representations, and Addenda
    Prevailing party recovers attorney fees. Tenant representations are material (misrepresentation = default). Lists all addenda incorporated into the lease.
  24. Notices, Agreement of Parties, and Information
    Covers notice requirements, entire agreement provisions, joint/several liability, Texas governing law, REALTOR copyright, tenant due diligence, credit reporting, death provisions, insurance, property management, and binding effect.
  25. Execution and Signatures
    Signature page with blocks for all parties and the landlord's confirmation of lease copy delivery.
