Form Outline

The TXR 1946 form is organized into the following sections:

  1. Header and Property Identification
    Links the addendum to the commercial contract by identifying the property address and the parties.
  2. Property
    Expands the property definition to include all improvements described in the Construction Documents, the unit's undivided interest in common elements, limited common elements, and any assigned parking or storage areas.
  3. Condominium Information Statement
    Establishes how the condominium information statement (required by Section 82.153 of the Property Code) is delivered to the buyer. If not yet received, seller must deliver within a specified number of days, and buyer has a 6-day cancellation right after receipt.
  4. Construction Issues
    Governs all construction matters including: construction documents incorporated by reference, written change orders with buyer-paid cost increases, buyer selection deadlines, construction commencement and completion requirements with force majeure, material substitution rights, and limited warranties with manufacturer warranty assignments.
  5. Condominium Association Fees
    Buyer pays association reserve deposits at closing. Transfer or processing fees are allocated to either seller or buyer by checkbox selection.
  6. Special Provisions
    Open text area for special provisions specific to this incomplete construction condominium transaction.
  7. Signature Block
    Signature blocks for up to two seller and two buyer signatories with entity name, signature, printed name, and title lines.
