TXR 1933Condominium Conversion Addendum

This addendum is attached to the New Residential Condominium Contract (TXR 1608 or 1609) when the condominium property is a conversion building -- a building previously used for a non-condominium purpose (e.g., apartments converted to condos) as defined by Section 82.003 of the Texas Property Code. Paragraph A records the status of the Seller's Disclosure Notice required by Section 5.008 (received; to be delivered within a stated number of days, with the buyer's right to terminate within 7 days after receipt or before closing; or not required of this seller), and Paragraph B whether the federal lead-based paint disclosure addendum for a pre-1978 dwelling is attached. A note lists the transfers to which Section 5.008 does not apply.

The TXR 1933 form is organized into the following sections:

  1. Header
    Identifies the addendum as an attachment to the new residential condominium contract and identifies the property.
  2. A. Seller's Disclosure Notice Pursuant to §5.008, Property Code (Notice)
    "(Check one box only.)" Handles the seller's disclosure notice for conversion buildings. If Buyer has not received the Notice, Seller must deliver it within a specified number of days, and Buyer may terminate within 7 days after receipt (or before closing, whichever first occurs); if Buyer never receives it, Buyer may terminate any time before closing.
  3. B. Seller's Disclosure of Lead-Based Paint and Lead-Based Paint Hazards
    Addresses federal lead-based paint disclosure requirements for a residential dwelling constructed prior to 1978: "An addendum providing such disclosure ❑ is ❑ is not attached to the contract."
  4. Signatures and Exemption Note
    Four signature rules — two captioned "Buyer" (left) and two "Seller" (right), no "Date" line — followed by the pre-printed Note on when Section 5.008 disclosure requirements do not apply. The rules are e-sign tabs.
