Form Outline

The TXR 1923 form is organized into the following sections:

  1. Property and Association Identification
    Identifies the property by address, city, and county, and confirms the certificate is prepared by the property owners' association.
  2. Right of First Refusal
    Discloses whether the subdivision's restrictions contain a right of first refusal or other transfer restraint that could affect the sale. Excludes rights of first refusal prohibited by statute.
  3. Current Regular Assessment
    States the regular HOA assessment (dues) amount and payment frequency for the property.
  4. Special Assessment
    Discloses any special assessment coming due after the certificate is delivered, including the amount, payment schedule, and purpose.
  5. Total Amounts Due and Unpaid
    Discloses the total unpaid balance the seller owes to the association for this property.
  6. Capital Expenditures
    Discloses capital expenditures approved for the current fiscal year.
  7. Reserves for Capital Expenditures
    Discloses the total amount held in reserve for future capital expenditures.
  8. Unsatisfied Judgments
    Discloses the total amount of unsatisfied judgments against the association.
  9. Pending Suits
    Discloses pending lawsuits against the association (excluding individual member tax suits), including the style and cause number of each case.
  10. Restriction Violations
    Discloses whether the association's board knows of any restriction, bylaw, or rule violations on the specific property being sold.
  11. Health or Building Code Violations
    Discloses whether the association has received any governmental code violation notices for the property or common areas. Copies must be attached.
  12. Administrative Transfer Fee
    Discloses all fees charged by the association upon transfer of ownership, including the administrative transfer fee and any other related fees with descriptions, payees, and amounts.
  13. Managing Agent Information
    Provides the name and contact information for the association's professional management company.
  14. Foreclosure Rights
    Discloses whether the HOA has the right to foreclose on the property if the owner fails to pay assessments.
  15. Required Attachments
    Lists the seven required documents that must accompany the subdivision information certificate.
  16. Change Notice
    Warns that the information in the certificate is a point-in-time snapshot and may change after issuance.
  17. Association Certification and Signature
    Provides the certification signature block for the authorized association representative.
