Form Outline

The TXR 1922 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the subject property by street address and city, and identifies the property owners association by name and phone number.
  2. Subdivision Information
    Defines Subdivision Information per Texas Property Code Section 207.003 and provides four options for how the information is obtained, paid for, and delivered. Only one option may be selected. Each option carries specific termination rights if the information is not delivered or is unsatisfactory.
  3. Material Changes
    Requires Seller to notify Buyer of material changes to Subdivision Information. Buyer may terminate prior to closing if information was untrue or if material adverse changes occur.
  4. Fees and Deposits for Reserves
    Sets a cap on the total association transfer fees, deposits, and reserves the Buyer will pay. The Seller pays any amount exceeding the cap. Excludes regular periodic dues (prorated at closing) and costs from Paragraphs A and D.
  5. Authorization
    Seller authorizes the HOA to release Subdivision Information to Buyer, Title Company, or brokers. If the Buyer did not request Subdivision Information but the Title Company needs HOA status information, the parties designate who pays for obtaining it.
  6. Notice to Buyer Regarding Repairs by the Association
    Warns Buyer that the HOA may be solely responsible for certain repairs and that the Buyer should be satisfied the HOA will make desired repairs before signing.
