TXR 1912Notices Regarding Contingency Under Addendum for Sale of Other Property by Buyer

This TXR-unique notice form provides a standardized way for sellers and buyers to communicate about the contingency created by TREC 10-6 (Addendum for Sale of Other Property by Buyer). It serves two functions on a single page: Part A allows the seller to formally notify the buyer that another offer has been accepted and that the buyer must waive the contingency (and deposit the additional earnest money) within the addendum's time or the contract terminates; Part B allows the buyer to respond by either waiving the contingency or declining to waive, which terminates the contract with the earnest money refunded to the buyer.

Form Outline

The TXR 1912 form is organized into the following sections:

  1. Header / Identification
    Identifies the seller, buyer, and property address that the notice relates to. Must match the parties and property in the underlying contract and TREC 10-6 addendum.
  2. A. Seller's Notice to Buyer to Remove Contingency
    The seller uses this section to formally notify the buyer that another offer has been accepted. It informs the buyer of three things: (1) another offer exists, (2) the buyer can waive the contingency by written notice plus depositing additional earnest money within the addendum's timeframe, and (3) failure to do so terminates the contract with earnest money refund. Pre-printed text; the two "Seller … Date" lines under it are e-sign tabs.
  3. B. Buyer's Response to Seller's Notice to Remove Contingency
    The buyer uses this section to formally respond to the seller's Part A notice. The buyer checks one of two boxes: (1) waive the contingency and deposit the additional earnest money, or (2) do not waive, which terminates the contract with the earnest money refunded. The two "Buyer … Date" lines under it are e-sign tabs.
