Form Outline

The TXR 1911 form is organized into the following sections:

  1. Parties
    Identifies the landlord (seller) and tenant (buyer) who are the parties to this lease.
  2. Lease
    States that the landlord (seller) leases the property to the tenant (buyer), identifying the property and the tenant as buyer.
  3. Term
    Defines the lease term commencement and termination dates. Terminates as specified in Paragraph 18. Maximum 90 days prior to closing.
  4. Rental
    Specifies the daily rental rate. Upon commencement, tenant pays the full rental amount for the anticipated term. If the actual lease term differs from anticipated, any additional rent or reimbursement is paid at closing. No portion of rental applies to contract items.
  5. Deposit
    Establishes a security deposit paid by the tenant (buyer) to the landlord (seller). The deposit is in addition to the earnest money. If the lease terminates by closing/funding, the deposit is refunded at closing. Otherwise, unused deposit is returned within 30 days after surrender and forwarding address.
  6. Utilities
    Tenant pays all utility connections, deposits, and charges except those specified as the landlord's responsibility.
  7. Use of Property
    Property may only be used for residential purposes. Tenant may not assign the lease or sublet.
  8. Pets
    No pets on the property except as specified.
  9. Condition of Property
    Tenant accepts the property as-is but the landlord (seller) must make all repairs and improvements required by the contract. If the lease terminates before closing, tenant surrenders the property in its present condition as improved by landlord, except normal wear and tear and casualty loss.
  10. Alterations
    Tenant may not make holes, drive nails, alter, paint, or decorate the property, or install improvements or fixtures without the landlord's prior written consent. Any improvements or fixtures placed become part of the property.
  11. Special Provisions
    Blank space for additional terms agreed upon by the parties.
  12. Inspections
    Landlord may enter at reasonable times to inspect, replace, repair, or complete improvements. Tenant must provide door keys and access codes.
  13. Laws, Repairs, Indemnity, Insurance, Default, and Termination
    Paragraphs 13-18 cover standard lease provisions: tenant must comply with all laws (13); tenant bears all repair/maintenance costs including yard, trees, shrubs, equipment, and appliances (14); tenant indemnifies landlord from third-party claims including attorney's fees (15); both parties must maintain insurance -- BUYER OCCUPANCY AS TENANT MAY CHANGE INSURANCE COVERAGE (16); tenant has 24-hour cure period after landlord notice before default (17); lease terminates upon (a) closing/funding, (b) contract termination prior to closing, (c) tenant default under lease, or (d) tenant default under contract -- if not by closing, tenant must surrender possession (18).
  14. Holding Over
    Holding over creates a tenancy at sufferance. Tenant must pay a specified daily holdover rate as damages.
  15. Attorney's Fees, Smoke Alarms, Security Devices, and Consult Attorney
    Paragraphs 20-23 cover: prevailing party recovers attorney's fees and costs (20); landlord must install smoke alarms per Texas Property Code, tenant waives inspection/repair duty (21); security device requirements do NOT apply to 90-day leases (22); real estate licensees cannot give legal advice, parties should consult an attorney (23).
  16. Notices
    All notices must be in writing. Provides contact information for both parties.
  17. Signatures
    Signature lines for two landlords and two tenants.
