Form Outline

The TXR 1907 form is organized into the following sections:

  1. Header and Identification
    Identifies the affidavit, the affiant(s), the property, and the survey date. The GF No. is the title company's internal guaranty file number used to track the transaction.
  2. Title Company Definition and Notary Preamble
    Defines 'Title Company' as the insurer relying on the affidavit and establishes the notary preamble: "Before me, the undersigned notary for the State of ____, personally appeared Affiant(s) who after by me being duly sworn, stated:". The notary completes the state at closing.
  3. 1. Ownership or Basis for Knowledge
    The affiant declares ownership of the property or states their alternative basis for having knowledge of the property (e.g., manager, lessee, neighbor). Printed text — no blank.
  4. 2. Familiarity with Property
    The affiant confirms they are personally familiar with the property and its improvements. Printed text — no blank.
  5. 3. Transaction Context and Title Insurance Coverage
    Establishes that the affidavit is being given in connection with a closing where area and boundary coverage has been requested. Acknowledges the title company's discretion to make exceptions and the owner's right to request similar coverage in the owner's policy for an additional premium. Printed text — no blank.
  6. 4. Affirmation of No Changes Since Survey
    The core affirmation. The affiant swears that since the survey date, there have been no new construction, boundary changes, adjacent construction near the boundary, or conveyances/easements affecting the property -- "EXCEPT for the following (If None, Insert “None” Below):" two ruled lines. This is the affiant's sworn answer.
  7. 5. Reliance and Limitation
    Acknowledges that the title company relies on the affidavit for coverage decisions. Limits the affidavit's scope: it is only for the title company's benefit and is not a warranty or guarantee of improvement locations. Printed text — no blank.
  8. 6. Limitation of Liability
    Limits the affiant's liability to cases where they personally knew information was incorrect and intentionally failed to disclose it. Good-faith errors based on actual knowledge do not create liability. Printed text — no blank (page 2).
  9. Perjury Declaration, Signatures, and Notarization
    Page 2: two side-by-side "I declare under penalty of perjury that the foregoing is true and correct. Signed: ____ / Affiant" boxes (e-sign tabs), then the notary jurat "SWORN AND SUBSCRIBED this ____ day of ____, 20____." and the "Notary Public" signature line — the jurat is completed by the notary at closing, not by the agent.
