Form Outline

The TXR 1906 form is organized into the following sections:

  1. Property Identification
    Identifies the property address to which this lead-based paint disclosure addendum applies.
  2. Lead Warning Statement
    Federally mandated warning statement informing buyers of the health risks of lead-based paint in pre-1978 homes, including neurological damage in children and risks to pregnant women. Notifies buyers that the seller must provide all known lead hazard information and recommends a professional inspection.
  3. Seller's Disclosure
    Two-part seller disclosure covering: (1) whether the seller has actual knowledge of lead-based paint or hazards in the property, and (2) whether the seller has records or reports about lead-based paint. If hazards are known or records exist, the seller must provide details.
  4. Buyer's Rights
    Gives the buyer the choice to either waive the right to a lead-based paint inspection or exercise the right to have the property inspected within 10 days. If the buyer inspects and finds lead hazards, the buyer may terminate within 14 days of the effective date with an earnest money refund.
  5. Buyer's Acknowledgment
    Buyer acknowledges receipt of the seller's lead-based paint disclosures and the EPA pamphlet 'Protect Your Family from Lead in Your Home.'
  6. Brokers' Acknowledgment
    Brokers acknowledge that they have informed the seller of all federal lead-based paint disclosure obligations and are aware of their own responsibility to ensure compliance. Lists six specific obligations brokers must communicate to sellers.
  7. Certification of Accuracy and Signatures
    All parties (buyers, sellers, and both brokers) certify that the information they provided is true and accurate to the best of their knowledge, and sign with dates.
