Form Outline

The TXR 1904 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the property address that connects this release to the underlying purchase contract. The property address must exactly match the contract.
  2. Notice / Warning
    A prominent warning that signing this form constitutes a full mutual release of all liability under the contract for all signing parties. Parties are advised to consult an attorney before signing if they have any questions.
  3. Mutual Release of Liability
    Establishes the mutual release where buyer and seller release each other and all transaction professionals (brokers, title company, escrow agent) from any and all liability arising from the contract.
  4. Earnest Money Disbursement Instructions
    Directs the named escrow agent to disburse the earnest money according to specified dollar amounts and recipients. Provides up to four disbursement line items for splitting funds among parties.
  5. Signature Block
    Signature lines for up to two buyers and two sellers (each with a "Date" under the right end of the line) and an "Address:" for each side, then the Other/Cooperating Broker and Listing/Principal Broker blocks — firm name, a "By ____ / Date" signature line for the broker or associate, and the brokerage address.
