TXR 1608New Residential Condominium Contract (Complete Construction)

This contract is used for the sale of a new residential condominium unit where construction is already complete. It addresses condominium-specific issues including the Condominium Information Statement (Section 82.153), the declaration and plat, common and limited common elements, parking areas, the association's right of refusal, conversion building disclosures, and association transfer fees. TXR-exclusive form with no TREC equivalent.

Form Outline

The TXR 1608 form is organized into the following sections:

  1. Effective Date
    The date of final acceptance — the broker fills the "EXECUTED the ___ day of ___, 20__" line on page 11 once the last party has signed. Leave it blank while preparing the offer; every deadline on this contract calculates from it once it is set.
  2. 1. PARTIES
    Identifies the seller (declarant / builder) and the buyer.
  3. 2. PROPERTY AND CONDOMINIUM INFORMATION STATEMENT
    Describes the condominium unit (unit, building, project, address, city, county), the parking areas assigned to it, whether Buyer has received the Condominium Information Statement (§82.153), and the Association right-of-refusal certification period.
  4. 3. SALES PRICE
    Cash portion payable at closing plus the financing described in the attached addenda. The Sales Price is calculated (Sum of A and B).
  5. 4. LEASES
    Residential leases, fixture leases and Natural Resource Leases affecting the Property (check all applicable boxes).
  6. 5. EARNEST MONEY AND TERMINATION OPTION
    Escrow Agent, earnest money, option fee, additional earnest money and the Option Period. Time is of the essence.
  7. 6. TITLE POLICY
    Who pays for the owner policy of title insurance, the Title Company, the use or activity Buyer may object to, and the objection period.
  8. 7. PROPERTY CONDITION
    Acceptance of the Property As Is (with or without specified repairs), the FTC insulation disclosure, the residential service contract reimbursement, and whether the Property is a conversion building.
  9. 8–10. BROKER OR SALES AGENT DISCLOSURE, CLOSING, AND POSSESSION
    Broker / sales agent party disclosure, the Closing Date, and when Buyer takes possession.
  10. 11. SPECIAL PROVISIONS
    Informational items only. Real estate brokers and sales agents are prohibited from practicing law and shall not add to, delete, or modify any provision of this contract.
  11. 12–15. SETTLEMENT AND OTHER EXPENSES, PRORATIONS, CASUALTY LOSS, DEFAULT
    Seller's contribution to Buyer's Expenses, the Association transfer fee cap, and the ¶12B brokerage-compensation contributions. Prorations, casualty loss and default carry no blanks.
  12. 16–21. MEDIATION, ATTORNEY'S FEES, ESCROW, REPRESENTATIONS, GOVERNMENTAL REQUIREMENTS, NOTICES
    Paragraphs 16–20 carry no blanks. Paragraph 21: notice addresses, phones and emails for Buyer, Seller and their agents (the preparing agent's own lines prefill from the sponsorship record).
  13. 22. AGREEMENT OF PARTIES — ADDENDA AND NOTICES
    The addenda and notices that are part of this contract (each checkbox is one line printed on pages 10–11). Filling the district-notices line or the "Other (list)" line checks its box automatically.
  14. 23. CONSULT AN ATTORNEY
    Each party's attorney, if any.
  15. EXECUTION AND SIGNATURES
    The EXECUTED line prints from the Effective Date at the top of the wizard (broker at final acceptance), the Chapter 27 notice is preprinted, and the two Buyer and two Seller lines on page 11 are e-signature tabs placed when you send. Buyer and Seller also initial the footer of pages 1–10.
  16. BROKER CONTACT INFORMATION
    Print name(s) only — this page is not signed. Three preprinted blocks: the firm representing Seller only (listing_*), the firm representing Buyer only (other_*), and an Intermediary firm representing both through separate associates (intermediary_*). Your own block prefills from the sponsorship record; the other broker completes theirs.
  17. EARNEST MONEY, CONTRACT, OPTION FEE, AND ADDITIONAL EARNEST MONEY RECEIPTS
    Page 13 is completed by the ESCROW AGENT / title company when it receipts the contract and funds. Its "Received by" / "Escrow Agent" lines and the Date/Time beside them are the escrow agent's signature, not a party e-sign tab. Agents leave this entire page blank.
