This form fulfills the Texas legal requirement under Section 1101.558 of the Occupations Code that a real estate license holder who represents a party in a proposed transaction must disclose that representation at the first contact with another party to the transaction or with another license holder

Form Outline

The TXR 1417 form is organized into the following sections:

  1. Property and License Holder Identification
    Header section identifying the property concerned, the broker or broker firm name with license number, and the broker's associate name with license number.
  2. Legal Requirement for Disclosure
    Cites Texas Occupations Code Section 1101.558, which requires a license holder representing a party in a proposed real estate transaction to disclose that representation, orally or in writing, at the license holder's first contact with another party to the transaction or another license holder representing another party.
  3. Party Represented by Broker
    The broker identifies which party they represent by selecting one of four checkboxes: Seller, Landlord, Buyer, or Tenant. A blank line next to each option allows entry of the party's name.
  4. Fiduciary Duty Statement
    Establishes that the license holder acting as agent is a fiduciary with the primary duty to represent client interests. While the license holder must treat other parties honestly and fairly, the duty to the client takes priority.
  5. Broker Compensation Notice
    A required notice that broker compensation and compensation sharing between brokers is not set by law, not fixed or controlled by any association, MLS, or listing service, and is fully negotiable. Brokers independently determine their fees.
  6. No Agency Relationship Acknowledgment and Signatures
    The non-represented parties sign to acknowledge that there is NO agency relationship with the disclosing broker as of the date of the disclosure. Two signature blocks are provided for the acknowledging parties.
