Form Outline

The TXR 1410 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the form, restricts use to TXR members, and provides a blank for the property address to link the termination to a specific listing agreement.
  2. Definitions
    Defines key terms used in the form: 'Owner' is the seller or landlord, and 'Listing' is the listing agreement being terminated.
  3. Representation
    The owner must affirmatively represent that there are NO negotiations currently pending or contemplated with anyone regarding the sale, lease, or exchange of the property.
  4. Termination Date
    Establishes the specific date and time at which the listing terminates. Termination occurs at 11:59 PM on the specified date.
  5. Termination Fees
    Establishes three categories of termination fees: (1) an immediate fee for services rendered, (2) a post-termination commission if the property sells or leases within a specified period, and (3) the scope of who the post-termination commission applies to.
  6. Release
    Provides a mutual release of all obligations under the listing agreement. The protection period clause from the original listing is explicitly voided. The only surviving obligations are those created by this termination document itself.
  7. Signature Block
    Signature block for the broker's company, the broker's associate, and up to two sellers or landlords. Each party must sign and date.
