Form Outline

The TXR 1410 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the form, restricts use to TXR members, and provides a blank for the property address to link the termination to a specific listing agreement.
  2. A. Definitions
    Defines key terms used in the form: 'Owner' means the seller or landlord of the Property, and 'Listing' means the above-referenced listing agreement. No blanks.
  3. B. Representation
    The owner represents that there are currently no negotiations pending or contemplated with anyone for the sale, lease, or exchange of the Property. No blanks.
  4. C. Termination Date
    Establishes the specific date at which the listing terminates. Termination occurs at 11:59 p.m. on the specified date.
  5. D. Termination Fees
    Three items: (1) a fee payable on execution for services rendered, (2) a fee if the Owner agrees to sell or lease on or before a date — check all that apply, and (3) who that D(2) fee applies to — check one box only.
  6. E. Release
    Mutual release of all obligations under or related to the Listing (including the protection period clause, which will no longer apply), except for the promises and representation in this document. No blanks.
  7. Signature Block
    Left column: the broker's (company's) printed name and license number, then the "By:" line signed by the broker's associate. Right column: two "Seller or Landlord" signature lines, each with a Date.
