Form Outline

The TXR 1406 form is organized into the following sections:

  1. Header and Property Identification
    Identifies property, disclaims warranty, and captures seller occupancy status.
  2. Property Items, Equipment, and Appliances
    Inventory of all property items marked Yes/No/Unknown. Covers appliances (dishwasher, disposal, microwave, oven, range, trash compactor), plumbing (hot tub, spa, water heater, water softener), HVAC (central A/C, evaporative coolers, wall/window AC, central heat, fireplace), pool and equipment, safety items (smoke detectors, carbon monoxide, fire detection, emergency escape ladder), structural features (fences, patio/decking, French drain, rain gutters, garage), technology (intercom, security system, satellite dish, cable wiring, TV antenna), outdoor (outdoor grill, underground sprinkler, solar panels), and utility connections. Also addresses water supply, pre-1978 construction, roof details, and defects.
  3. Defects or Malfunctions in Structural/System Components
    Seller marks Y or N for awareness of defects in: basement, ceilings, doors, driveways, electrical systems, exterior walls, floors, foundation/slab, interior walls, lighting fixtures, plumbing systems, roof, sidewalks, walls/fences, windows, and other structural components.
  4. Environmental and Hazardous Conditions
    Comprehensive Y/N disclosure covering hazardous materials, geological conditions, water/drainage issues, pest history (termites/WDI), easements, encroachments, land use history, structural repair history, and special designations. Approximately 35 items across two columns spanning pages 2-3.
  5. Additional Items in Need of Repair
    Catch-all for any items, equipment, or systems needing repair not covered in Sections 1-3.
  6. Flood-Related Conditions
    Flood history and flood zone disclosure: current insurance coverage, previous flooding events, water penetration, and whether property is in 100-year floodplain, 500-year floodplain, floodway, flood pool, or reservoir (wholly or partly).
  7. Flood Insurance Claims
    Disclosure of any flood damage insurance claims filed, including through NFIP.
  8. FEMA or SBA Flood Assistance
    Disclosure of FEMA or SBA flood damage assistance received.
  9. Legal, HOA, and Miscellaneous Conditions
    Broad disclosure covering unpermitted construction, HOA details, common facilities, deed violations, lawsuits, property deaths, health/safety conditions, environmental remediation, rainwater harvesting, propane districts, and groundwater/subsidence districts.
  10. Previous Inspection Reports
    Disclosure of inspection reports received within the last 4 years. Seller should attach copies.
  11. Tax Exemptions
    Disclosure of current tax exemptions claimed for the property.
  12. Non-Flood Insurance Claims
    Disclosure of non-flood insurance claims filed for the property.
  13. Unrepaired Insurance/Legal Proceeds
    Disclosure of insurance or legal proceeds received for property damage where repairs were not made.
  14. Smoke Detector Compliance
    Smoke detector compliance with Chapter 766 of the Texas Health and Safety Code.
  15. Seller Certification and Signature
    Seller certification of truthfulness and that no one influenced inaccurate or incomplete disclosures.
  16. Additional Notices to Buyer
    Informational notices about sex offender registries, coastal regulations, windstorm insurance, military noise, square footage verification, utility providers, and broker reliance.
  17. Buyer Acknowledgment and Signature
    Buyer acknowledges receipt and is encouraged to obtain independent inspections.
