Form Outline

The TXR 1405 form is organized into the following sections:

  1. To: (Owners' Association)
    Three lines under "To:": the owners' association's name, its street address, and its city, state and zip.
  2. Re: Notice of Intended Sale/Purchase and Request for Information
    "This notice is to advise you that I intend to ❑ sell ❑ purchase the Property at:" followed by the Property's address line and its city, state, zip line.
  3. I am requesting the following information
    Two "❑" boxes: Residential Subdivision Information (restrictions, bylaws and rules, and a §207.003 resale certificate) or Condominium Information (declaration, bylaws and rules, and a §82.157 resale certificate). "Note: Only sellers may request Condominium Information."
  4. Please deliver the information to
    The recipient's name with a "(❑ Broker ❑ Owner ❑ Buyer ❑ Closing Agent)" box run, then "Attn:", (Address), (City, State, Zip), (phone) (fax) and (e-mail) lines.
  5. Statutory Delivery Requirement and Right of First Refusal
    Reminds the owners association of the statutory 10-business-day delivery requirement under the Texas Property Code and asks it to advise of any right of first refusal or other information it requires. No blanks.
  6. Enclosed is $____ for the cost, if any, for the requested information
    The amount enclosed to cover the owners association's fee for providing the requested information. The "$" is printed on the paper.
  7. Signatures
    Two rules: "Owner … Date" and "Buyer … Date". The requester signs — the Owner when selling, the Buyer when purchasing. All are e-sign tabs placed when the form is sent.
  8. Enclosure Note
    "Enclosure: TREC Resale Certificate (TXR No. 1921 for Condominiums; TXR No. 1923 for Subdivisions)" — attach the matching blank resale certificate. No blanks.
