Form Outline

The TXR 1403 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the property address and links this addendum to the existing listing agreement.
  2. Definitions
    Defines 'Owner' as the seller or landlord, and 'Excluded Prospect' as any prospective buyer or tenant who has direct communication with the owner, was procured through the owner's sole efforts, and is properly identified per Paragraph D.
  3. Exclusive Agency
    Grants the owner the right to sell or lease to an Excluded Prospect without paying the full listing commission, provided the owner does not use any other real estate broker for marketing or assistance.
  4. Broker's Fees
    Specifies the reduced fee the owner pays the broker when selling or leasing to an Excluded Prospect. Options include a percentage of sales price, percentage of gross rent, or a custom fee arrangement.
  5. Naming of Excluded Prospects
    Requires the owner to provide written notice to the broker identifying each Excluded Prospect by name, address, and phone number. If any broker shows the property to the prospect before the owner provides this notice, the person cannot qualify as an Excluded Prospect.
  6. Offers from Excluded Prospects
    Requires the owner to immediately notify the broker about all Excluded Prospect activity: offers received, acceptances (with contract copies), closings, and terminations.
  7. Effect on Listing upon Sale or Lease to an Excluded Prospect
    If the owner contracts with an Excluded Prospect, the broker has no further service obligation for that transaction and may either terminate the listing or continue marketing for back-up offers.
  8. Public Marketing
    Restricts the methods by which the owner may publicly market the property. Options include signs, newspaper, Internet, or other specified methods. Includes an MLS filing requirement if the owner publicly markets and box 6A(2) is checked in the listing.
  9. Signatures
    Signature block for broker (or associate) and owner(s).
