Form Outline

The TXR 1403 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the property address and links this addendum to the existing listing agreement.
  2. A. Definitions
    Defines 'Owner' as the seller or landlord, and 'Excluded Prospect' as a prospective buyer or tenant who (a) has direct communication or negotiations with the owner, (b) is procured through the owner's sole efforts, and (c) the owner identifies as required by Paragraph D. No blanks.
  3. B. Exclusive Agency
    Owner may sell or lease the Property to an Excluded Prospect if Owner does not use any other real estate broker to market or assist. No blanks.
  4. C. Broker's Fees
    If Owner sells or leases to an Excluded Prospect, Owner does not owe the Broker's Fee under Paragraph 5 of the Listing but pays Broker, at closing or lease commencement, the fee checked here (check all that apply): (1) % of the sales price, (2) % of the gross rent, or (3) other.
  5. D. Naming of Excluded Prospects
    Requires the owner to provide written notice to the broker identifying each Excluded Prospect by name, address, and phone number. If any broker shows the property to the prospect before the owner provides this notice, the person cannot qualify as an Excluded Prospect. No blanks.
  6. E. Offers from Excluded Prospects
    Requires the owner to immediately notify the broker about all Excluded Prospect activity: offers received, acceptances (with contract copies), closings, and terminations. No blanks.
  7. F. Effect on Listing upon Sale or Lease to a Named Exclusion
    If the owner contracts with an Excluded Prospect, the broker has no further service obligation for that transaction and may either terminate the listing or continue marketing for back-up offers. (The paper's heading says "Named Exclusion"; the body says "Excluded Prospect".) No blanks.
  8. G. Public Marketing
    Owner may publicly market the Property only by the methods checked: signs, newspaper, Internet, or an other method written in. NOTE on the paper: if the Property is listed for sale with box 6A(2) of the Listing checked and Owner publicly markets it, Broker must file the Listing with the MLS within one business day.
  9. Signatures
    Left column: Broker's Printed Name and License No., the Broker's (or Broker's Associate's) signature with Date, and the Broker's Associate's Printed Name, if applicable, with License No. Right column: two Owner blocks, each a printed name and a signature line with Date.
