Form Outline

The TXR 1402 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the property address and links this addendum to the existing listing agreement.
  2. A. Definitions
    (1) 'Owner' means the seller or landlord of the Property. (2) 'Named Exclusion' means the persons listed by the owner who are excluded from the broker's standard fee.
  3. B. Contract with a Named Exclusion
    B(1): if the Owner contracts with a Named Exclusion within the stated number of days after the Listing begins, the Owner owes the reduced fee checked here (check all that apply: % of the sales price, % of the gross rent, or other) instead of the Broker's Fee under Paragraph 5. B(2)/B(3): after that period, or if the Named Exclusion routes an offer through any broker, the exclusion ends and the full fee applies.
  4. C. Offers from Named Exclusions
    Requires the owner to immediately notify the broker of all activity with Named Exclusions: receipt of offers, acceptance (with a copy of the contract), closing, and any termination of a contract that does not close. No blanks.
  5. D. Effect on Listing upon Sale or Lease to a Named Exclusion
    If the owner contracts with a Named Exclusion within the exclusion period, the broker has no obligation to provide further services for that transaction. The broker may either terminate the listing or continue marketing for back-up offers. No blanks.
  6. Signatures
    Left column: Broker's Printed Name and License No., the Broker's (or Broker's Associate's) signature with Date, and the Broker's Associate's Printed Name, if applicable, with License No. Right column: two Owner blocks, each a printed name and a signature line with Date.
