Form Outline

The TREC 55-1 form is organized into the following sections:

  1. Header and Disclaimer
    Identifies the property and establishes that the disclosure is based solely on the seller's knowledge, not a warranty or substitute for inspections.
  2. Seller Occupancy Status
    Establishes whether the seller currently lives in the property or has vacated, and if so, for how long.
  3. Appliances, Systems, and Equipment Inventory
    Comprehensive inventory of all appliances, systems, and equipment. Seller writes Y (yes/present), N (no), or U (unknown) for each item, then discloses any known defects or repair needs.
  4. Smoke Detectors
    Asks whether working smoke detectors are installed per state code. Includes provisions for hearing-impaired detector installation.
  5. Structural and System Defects
    Asks seller to disclose known defects/malfunctions in each interior/exterior building component. Write Yes (Y) if aware, No (N) if not aware.
  6. Environmental and Property Condition Issues
    Covers environmental concerns, pest history, soil issues, drainage, water damage, and significant property history items affecting value or habitability. Write Yes (Y) if aware, No (N) if not aware.
  7. Items Needing Repair
    Broad catch-all asking if seller knows of anything needing repair not covered in prior sections.
  8. Flood Conditions and Floodplain Location
    Comprehensive flood disclosure covering insurance, flooding history, and floodplain/floodway/reservoir/flood-pool location. Write Yes (Y) if aware (and check wholly/partly as applicable), No (N) if not aware.
  9. Flood Insurance Claims and Federal Assistance
    Discloses prior flood insurance claims (any provider including NFIP) and federal disaster assistance (FEMA/SBA) received for flood damage.
  10. Additional Property Conditions, Insurance, and Legal Issues
    Y/N awareness checklist for legal, association, and condition issues. The 2026 revision (Sunset Commission directive) added six disclosures: conservation easements; whether the Property is presently covered by insurance; windstorm insurance coverage; whether Seller has been unable to insure the Property for any reason; private roads on or adjoining the Property that Seller must maintain; and aboveground/underground storage tanks (two items, including 500+ gallon petroleum/chemical tanks).
  11. Coastal Property and Military Installation Notices
    Informational notices about coastal property restrictions (Open Beaches Act, Dune Protection Act) and military installation proximity (noise/compatible use zones).
  12. Signatures
    Seller execution signatures and purchaser acknowledgment of receipt.
