Form Outline

The TREC 54-1 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the form, states its applicability to residential leases only, and establishes the property address the notice concerns.
  2. 100-Year Floodplain Disclosure
    Requires the landlord to disclose awareness of whether the property is in a 100-year floodplain. Provides a safe-harbor presumption if neither box is checked and advises tenants about FEMA maps and flood insurance.
  3. Flooding History Disclosure
    Requires the landlord to disclose whether they have knowledge that the property has experienced flooding within the past five years.
  4. Definitions
    Defines three key terms used in the notice: 100-year floodplain (FEMA-designated 1% annual flood risk area), flooding (inundation from natural water sources or excessive rainfall), and dwelling (rooms rented as a permanent residence under a single lease).
  5. Signatures and Acknowledgment
    Provides signature and date lines for up to two landlords and two tenants. The tenant's signature constitutes acknowledgment of receipt of the flood notice.
