The TREC 47-0 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the property subject to the propane gas system service area notice. The address must match the main contract exactly to properly link the addendum.
  2. Notice to Buyer
    Provides the statutory notice to the buyer about the property potentially being in a propane gas system service area. It warns of possible special costs, charges, and construction periods before propane gas service can be provided, and advises the buyer to contact the distribution system retailer for specifics.
  3. Buyer Acknowledgment of Receipt
    The buyer formally acknowledges receiving this notice, which must occur at or before contract execution or at closing. This satisfies the legal requirement under the Texas Utilities Code.
  4. Recorded Notice Attachment Requirement
    The addendum requires that a copy of the distribution system retailer's recorded notice from the county real property records be physically attached. The seller can obtain this from the county clerk's office or directly from the retailer.
  5. Signatures and Dates
    Provides signature and date lines for up to two buyers and two sellers. All parties to the contract should sign and date the addendum to confirm acknowledgment of the propane gas service area notice.
