Form Outline

The TREC 30-18 form is organized into the following sections:

  1. Parties
    Names the seller and buyer who are entering into the contract.
  2. Property and Condominium Documents
    Comprehensive property description section specific to condominiums, including unit identification, improvements, accessories, exclusions, condo documents delivery, resale certificate, and association right of refusal.
  3. Sales Price
    Defines the sales price structure: cash at closing plus sum of all financing from attached addenda.
  4. Leases
    Addresses any existing leases on the property and restricts Seller from creating new leases after the Effective Date.
  5. Earnest Money and Termination Option
    Sets the earnest money deposit, option fee, termination option period, and strict timing requirements. Time is of the essence.
  6. Title Policy
    Title insurance provisions including who pays, standard exceptions, condo-specific exceptions, commitment delivery timeline, objection/cure process, and statutory notice requirements.
  7. Property Condition
    Comprehensive property condition section covering inspections, disclosures, as-is acceptance, repairs, environmental concerns, and home warranty options.
  8. Brokers and Sales Agents
    Broker/agent disclosure requirements and confirmation that fees are in separate agreements.
  9. Closing
    Establishes the closing date and outlines each party's obligations at closing, including deed delivery, payment, and lien clearance.
  10. Possession
    Governs when Buyer takes possession, warns about insurance implications, and addresses Smart Device transfer requirements.
  11. Special Provisions
    Blank space for informational items only; agents cannot draft legal provisions here.
  12. Settlement and Other Expenses
    Allocates closing costs between Seller and Buyer, including Seller concessions and Association transfer fee caps.
  13. Prorations
    Prorates taxes, rents, and condo association fees through closing. Cash reserves for condo capital improvements are not credited to Seller.
  14. Casualty Loss
    Addresses property damage before closing for both the unit and common elements, with termination and restoration options.
  15. Default
    Default remedies for both parties including specific performance, legal relief, and earnest money disposition.
  16. Mediation
    Requires mediation before litigation for disputes, with costs split equally.
  17. Attorney's Fees
    Prevailing party in legal proceedings recovers attorney's fees and costs.
  18. Escrow
    Escrow agent liability limitations, earnest money application priority, and release/demand procedures.
  19. Representations
    Representations survive closing; false representations constitute default.
  20. Federal Requirements
    FIRPTA withholding requirements for foreign sellers.
  21. Notices
    Notice delivery requirements and contact information for both parties and their agents.
  22. Agreement of Parties
    Entire agreement clause and comprehensive checklist of all available addenda. attached_addenda is a legacy catch-all key superseded by the per-addendum checkboxes below (each checkbox below matches one line item printed on the paper form).
  23. Consult an Attorney Before Signing
    Advisory to consult attorneys; agents cannot give legal advice.
  24. Execution and Effective Date
    Execution block where all parties sign and the broker fills in the Effective Date (date of final acceptance).
  25. Broker Contact Information
    Broker firm names and license numbers (print only — this page is not signed). Representation is PREPRINTED on the 30-18's Broker Contact Information page — there are no representation checkboxes and no subagency option (subagency is no longer practiced in Texas). Broker compensation lives in Paragraph 12, not here. Three printed blocks: Seller's agent (listing_*), Buyer's agent (other_*), and Intermediary (intermediary_* — one firm representing both parties through separate associates, distinct from illegal dual agency).
  26. Option Fee, Earnest Money, and Additional Earnest Money Receipts
    The receipt blocks (including their dates) are completed by the TITLE COMPANY / escrow agent at receipt. Agents should normally leave this entire section blank.
