Form Outline

The TREC 28-2 form is organized into the following sections:

  1. Header and Property Identification
    Identifies the form as the TREC Environmental Assessment, Threatened or Endangered Species, and Wetlands Addendum and links it to the main contract via the property address.
  2. Environmental Assessment
    Gives the buyer the option to hire an environmental specialist to conduct an environmental assessment of the property. The assessment is entirely at the buyer's cost.
  3. Threatened or Endangered Species
    Gives the buyer the option to hire a natural resources professional to evaluate whether the property harbors any protected species or their habitats. The report covers both state (TPWD) and federal (USFWS) designations.
  4. Wetlands
    Gives the buyer the right to obtain a wetlands determination from an environmental specialist. Wetlands are defined by federal or state law and can significantly restrict land use and development.
  5. Termination Provision and Assessment Period
    Sets the deadline for the buyer to exercise the termination right. The buyer must furnish the seller with both a copy of the adverse report and a notice of termination within the specified number of days after the effective date. Earnest money is refunded upon proper termination.
  6. Signatures
    Provides signature lines for all buyers and sellers. The addendum must be signed by all parties to the contract to be effective.
